Politics from the Bench? Ideology and Strategic Voting in the U.S. Supreme Court

چکیده

In the United States, Supreme Court justices often vote along ideological lines. Why this is case remains incompletely understood. To learn more about justices’ preferences and nature of decision-making in Court, we differentiate between votes that were pivotal those not. Statistical mechanics of the US Supreme Court

We build simple models for the distribution of voting patterns in a group, using the Supreme Court of the United States as an example. The least structured, or maximum entropy, model that is consistent with the observed pairwise correlations among justices’ votes is equivalent to an Ising spin glass. While all correlations (perhaps surprisingly) are positive, the effective pairwise interactions...

Taking the Measure of Ideology: Empirically Measuring Supreme Court Cases

INTRODUCTION Although the tools of empirical legal analysis have become increasingly sophisticated, much of this development has been asymmetrical. Empiricists have developed numerous ways of assessing the inputs of legal processes-especially in relation to judicial ideology-however, until very recently, there have been no comparably sophisticated measures of the outputs of legal processes case...

Factor analysis versus multi-dimensional scaling: binary choice roll-call voting and the US Supreme Court

We evaluate factor analysis and multi-dimensional scaling (MDS) as tools for the analysis of voter decisions over a series of dichotomous choices. We simulate binary voting data with a known form and illustrate that standard factor analyses of these types of data yield additional artifactual dimensions. This effect may be exacerbated by the choice of inter-voter measures of similarity used as i...

Dialogues in US Supreme Court Oral Hearings

Dialogue protocols in Artificial Intelligence and Law have become increasingly stylised, intended to examine the logic of particular legal phenomena such as burden of proof, rather than the procedures within which these phenomena occur. In this paper we will return to the original idea of using dialogue to model particular procedures by examining some very particular dialogues those found in or...

The Politics of Scandals: The Case of Supreme Court Nominations

We examine the role of scandals in the politics of Supreme Court nominations, 1877-1994. We argue that when a nominee’s opponents control the process, they often delay it in the hope of uncovering a scandal. If they succeed in finding a scandal, they further delay the process in order to exploit the scandal and damage the nominee’s prospects of confirmation. Evidence from a Markov model of the ...
